{"id":2891,"date":"2014-09-23T10:40:22","date_gmt":"2014-09-23T17:40:22","guid":{"rendered":"https:\/\/realuoso.com\/?p=2891"},"modified":"2015-07-22T19:18:51","modified_gmt":"2015-07-23T02:18:51","slug":"nar-code-ethics-illegal","status":"publish","type":"post","link":"https:\/\/theamericangenius.com\/housing\/board-associations\/nar-code-ethics-illegal\/","title":{"rendered":"NAR reacts to assertions that the Code of Ethics may be illegal"},"content":{"rendered":"<p>Last week, real estate blogger, <a href=\"https:\/\/www.notorious-rob.com\/2014\/09\/19\/the-nar-code-of-ethics-is-illegal-probably\/\" title=\"NAR Code of Ethics\" target=\"_blank\">Rob Hahn suggested<\/a> that the National Association of Realtors&#8217; (NAR&#8217;s) Code of Ethics (COE) is &#8220;probably&#8221; illegal based on a recent Federal Trade Commission (FTC) complaint against the National Association of Residential Property Managers (NARPM) that Hahn opines &#8220;should be sending shockwaves throughout the ranks of REALTOR Associations.&#8221;<\/p>\n<p>The FTC alleges &#8220;that NARPM and its members restrained competition&#8221; through their Code of Ethics which forbids members from criticizing competitors or soliciting their clients, much like the NAR&#8217;s COE. The proposed consent order would require NARPM to &#8220;stop restraining its members from soliciting property management work, and from making statements that are not false or deceptive about a competitor\u2019s products, services, or business or commercial practices.&#8221;<\/p>\n<p>Sound familiar? <\/p>\n<p>&#8220;Given the similarities involved in the NARPM case and as-yet-unfiled NAR case,&#8221; Hahn writes, &#8220;I assume the only issue will be whether NAR proactively changes its Code of Ethics, or waits for the FTC to file a complaint.
