I mean that\u2019s the way it\u2019s supposed to work. That\u2019s what makes America great.<\/p>\n<blockquote><p>Every now and then it doesn\u2019t happen that way. More and more frequent is the use of \u201cnon-disparagement\u201d or \u201cgag\u201d clauses in fine print by companies in an attempt to block negative publicity. <\/p><\/blockquote>\n<div align=\"center\"><i class=\"icon-bookmark\"><\/i> <strong>Read also: <a href=\"https:\/\/therealdaily.com\/real-estate-brokers\/fighting-good-fight-supporting-legislation-customer-reviews\/\">Why we support legislating consumer reviews<\/a><\/strong><\/div>\n<p><img decoding=\"async\" src=\"https:\/\/theamericangenius.com\/wp-content\/uploads\/2015\/09\/the-real-daily-news.png\" alt=\"bar\" width=\"100\" height=\"19\" class=\"alignnone size-full wp-image-91813\" \/><br \/>\nThe most well known and famous example of this involves <a href=\"https:\/\/consumerist.com\/2014\/06\/26\/kleargear-com-ordered-to-pay-306k-to-couple-who-wrote-negative-review\/\" target=\"_blank\" rel=\"nofollow\">online retailer, KlearGear and a couple who went online with a critical review of services rendered.<\/a><\/p>\n<h2>Fighting back against this trick<\/h2>\n<p>In one of the quicker moves to resolve this type of big business abuse, the Senate has passed a bill to nix the use of these tricky \u201cnon-disparagement\u201d or \u201cgag\u201d clauses, which again would prevent consumers from providing their honest opinions in public forums, bringing it one major step closer to becoming law.<\/p>\n<p>The bill has been referred to the Subcommittee on Commerce, Manufacturing, and Trade, and if passed by the full Congress, the <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-bill\/2044\" target=\"_blank\" rel=\"nofollow\">Consumer Review Freedom Act<\/a> would give the Federal Trade Commission and state attorneys general the authority to take enforcement action against businesses that attempt to these ethically questionable clauses to quiet consumers.<\/p>\n<p>Although previous attempts at legislation on a national level have fallen short, it looks like the Senate is doing the right thing in an effort to protect consumers.<\/p>\n<h3>#GagClause<\/h3>\n","protected":false},"excerpt":{"rendered":"<p>Brands are putting gag clauses in fine print to disallow customers from ever leaving a negative review of them online (lest they be sued).
