{"id":7939,"date":"2016-05-20T09:09:40","date_gmt":"2016-05-20T16:09:40","guid":{"rendered":"https:\/\/therealdaily.com\/?p=7939"},"modified":"2016-05-20T09:09:40","modified_gmt":"2016-05-20T16:09:40","slug":"new-criminal-background-checks-mean-real-estate","status":"publish","type":"post","link":"https:\/\/theamericangenius.com\/housing\/politics\/new-criminal-background-checks-mean-real-estate\/","title":{"rendered":"What the new criminal background checks mean for real estate"},"content":{"rendered":"<p>If you consider that that nearly a third of Americans, 100 million people in all, have a criminal record (with an additional 650,000 released from prison each year) it kind of justifies some\u00a0seeking to run a criminal background check on a potential client for sales or rental purposes.<\/p>\n<div align=\"center\"><i class=\"icon-bookmark\"><\/i> <strong>Read also: <a href=\"https:\/\/therealdaily.com\/real-estate-brokers\/exploring-gun-ownership-in-the-real-estate-industry\/\">Exploring gun ownership in the real estate industry<\/a><\/strong><\/div>\n<p><img decoding=\"async\" class=\"alignnone size-full wp-image-91813\" src=\"https:\/\/theamericangenius.com\/wp-content\/uploads\/2015\/09\/the-real-daily-news.png\" alt=\"bar\" width=\"100\" height=\"19\" \/><br \/>\nAt the recent [REALTORS] Legislative Meetings &amp; Trade Expo in Washington, D.C.,\u00a0a forum titled, \u201cCriminal Background Checks, Fair Housing Compliance and You\u201d posited that, \u201cThe three things [realtors] need to do when developing a program are have consistent procedures, uniform standards, and an explanation for criminal background check programs.\u201d<\/p>\n<h2>Just who is protecting whom?<\/h2>\n<p>The Department of Housing and Urban Development (HUD) published the <a href=\"https:\/\/portal.hud.gov\/hudportal\/documents\/huddoc?id=HUD_OGCGuidAppFHAStandCR.pdf\" target=\"_blank\" rel=\"nofollow\">Fair Housing Act guidance<\/a> on April 4 that has raised concerns for housing providers who use criminal history screening processes to make decisions about sales, rentals financing and other real estate activity.<\/p>\n<p>Consider this: minorities are a protected class under the Fair Housing Act. Persons with criminal records are not. So are those individuals being biased? The interpretation of HUD\u2019s guidance is that creating arbitrary or blanket criminal-based policies and restrictions could potentially violate the Fair Housing Act.<\/p>\n<h2>Do\u2019s and Don\u2019ts<\/h2>\n<p>For its part, the National Association of Realtors (NAR) has summarized HUD\u2019s guidance in a \u201c<a href=\"https:\/\/www.realtor.org\/articles\/fair-housing-act-criminal-history-based-practices-and-policies\" target=\"_blank\" rel=\"nofollow\">Do\u2019s and Don\u2019ts\u201d guide<\/a>, with tips that urge real estate professionals to uniformly consider criminal history, regardless of an individual\u2019s protected class status, while avoiding policies that exclude anyone based on arrest records alone. Selected examples can be seen below:<\/p>\n<table width=\"449\">\n<tbody>\n<tr>\n<td width=\"209\"><strong>Do&#8217;s<\/strong><\/td>\n<td width=\"215\"><strong>Don&#8217;ts<\/strong><\/td>\n<\/tr>\n<tr>\n<td width=\"209\">Create tailored criminal history-based policies\/practices.<\/td>\n<td width=\"215\">Don\u2019t create arbitrary or overly-broad criminal history-based policies\/practices.<\/td>\n<\/tr>\n<tr>\n<td width=\"209\">Be sure to have clear, specific reasoning for the criminal history-based policy\/practice that can be supported by evidence.<\/td>\n<td width=\"215\">Don&#8217;t maintain a policy\/practice, or any portion thereof, that does not serve a substantial, legitimate, nondiscriminatory interest.<\/td>\n<\/tr>\n<tr>\n<td width=\"209\">Exclude individuals only based on criminal convictions that present a demonstrable risk to resident safety or property.<\/td>\n<td width=\"215\">Don\u2019t create exclusions based on arrest records alone.<\/td>\n<\/tr>\n<tr>\n<td width=\"209\">Consider the nature and severity of an individual\u2019s conviction before excluding the individual based on the conviction.<\/td>\n<td width=\"215\">Don&#8217;t create a blanket exclusion of any person with any conviction record.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Granted, everyone has a right to live wherever they can afford, and that means strong support for the Fair Housing Act and its mission.
